DECISION:
1. Upon review of the Application submitted by the Applicant, the Zoning Administrator
determined pursuant to Nantucket Zoning By -Law Section 139-33.A(1)(b) that the
proposed alteration and structural changes to the pre-existing non -conforming structure
upon the pre-existing nonconforming locus do not increase the non -conforming nature of
the structure or the locus.
2. The Applicant proposes to alter the pre-existing nonconforming structure by removing
and reconstructing portions thereof. The structure will be no closer to the front yard lot
line than the existing structure as a result of the proposed alterations and no new
nonconformities will be created. The proposed project has been granted Historic District
Commission approval by virtue of Certificate of Appropriateness 70860.
3. The Locus is pre-existing nonconforming as to the intensity and dimensional
requirements in the Residential Twenty (R-20) zoning district. Specifically, Locus is an
undersized lot of record having 1) lot area of 12,015 square feet where minimum lot area
is 20,000 square feet, and 2) 20.15 feet of frontage where minimum required frontage is
seventy (75) feet. The existing structure is a single family dwelling with attached garage,
sited as close as 29.6 feet from the front yard lot line where minimum front yard setback
is thirty (30) feet. There is a forty-five (45) square foot utility shed sited on the rear and
side yard lot lines in the southeast corner. The existing ground cover is roughly 1,743±
square feet, equivalent to a Ground Cover Ratio of 14.5% ("GCR") where maximum
allowed would be 1,501 square feet, pursuant to 12.5% GCR.
4. Applicants propose to 1) remove the existing two -bay garage, decks, breezeway, and
stoops, and 2) construct a 735 square foot addition. The addition consists of a single -story
one -bay garage, basement, mudroom, dining area, and unenclosed deck and porch. After
demolition, the structure will contain 1,008 square feet of ground cover. With the 735
square foot addition, the resulting structure will retain the initial ground cover of 1,743±
square feet. The addition will be sited no closer than 33.3 feet from the front yard lot line,
and the nonconforming utility shed will be removed, thus curing all setback
nonconformities. As shown on the plan entitled, "Proposed Site Plan in Nantucket, MA.",
dated May 2, 2018, revised on August 22, 2018, and September 6, 2018, prepared for
James C. Herbert & Kathleen H. Herbert, by Bracken Engineering, Inc., a copy of which

is attached hereto as "Exhibit A", the alterations will cure all setback nonconformities
and will not increase the pre-existing nonconforming ground cover.
5. Based upon the foregoing, the Zoning Administrator finds that the proposed alterations to
the pre-existing nonconforming structures upon the pre-existing nonconforming lot will
cure the setback nonconformities and will not result in a change to the pre-existing
nonconforming ground cover. Accordingly, the permit may be issued on the basis that the
proposal will not increase the nonconforming nature of the structures or the locus, will in
fact cure all setback nonconformities, and will not create any new nonconformities. This
approval is subject to the following condition:
a) The proposed alterations shall be performed in substantial conformity with
Certificate of Appropriateness No. 70860 granted by the Nantucket Historic District
Commission, as the same may be amended from time to time.
b) The Locus shall be in substantial accordance with the above -referenced proposed
conditions site plan, attached herewith as "Exhibit A".
