The locus, 14 Easy Street, is a dimensionally conforming lot of 4,522+/- SF in the
Commercial Downtown (CDT) Zoning District. Applicant previously received Special
Permit relief from the Zoning Board of Appeals under Files 57-14, 69-14, and 18-15 to
partially demolish and alter the existing 2 -story mixed use structure, to change the use,
and to make other changes. The structure was rebuilt as a building with two retail shops
on the first floor and with two apartments on the second and third floor. The Locus had
substantial brick sidewalks, patio, and parking that predated the 20% open space
requirement of 139-16(E) and the original zoning relief application in 2014 sought relief
for it under 139-16(E) or the alteration of pre-existing non -conforming structures at 139-
33(A), but during the hearing process, it was determined that the proposed development
did not need relief from that provision, since the proposed open space was over 26%.
The Board granted the Special Permit relief requested, but condition 5.c of the relief
requires the application to "provide for 20% open space, as defined in the Bylaw." In
2016, Town Meeting voted to change the bylaw to exclude the CDT zoning district from
the 20% open space requirement, but the condition potentially remains on this lot
pursuant to condition 5.c.
Applicant seeks confirmation that condition 5.c no longer applies, since the
definition of open space does not apply in the CDT District. In the alternative,
Application seeks relief to eliminate the requirement of 5.c to eliminate the open space
requirement for this locus. In the alternative, Applicant seeks relief to adjust the open
space requirement to allow for the construction of a second parking space, as per the
attached plan, which would have an open space ratio of about 19.2%.
