The Locus has a lot area of about 10,236 sf and contains a duplex with a foot print of about 798 SF. The Applicant has a permit from the Planning Board to convert the basement of the structure to a year-round restricted tertiary dwelling, and to add a small addition to the lower level. However, since the lot slopes away from the house to the rear, and the existing building was constructed at a Average Mean Grade height of 28.5 feet, with the rear (north) side as high as 32.5 -feet (where only 32.0 feet is allowed) any addition to the north side of the structure requires relief, even though no alteration is being made to the actual height of the structure because the by-law requires that the height for the overall structure be measured to a single highest point. This nonconformity is now considered a preexisting nonconforming condition, as it is more than 10 years old. The property is otherwise dimensionally conforming. In this case the addition is single -story addition about 8 -feet deep and 12 -feet tall, extending the walk out basement. This addition causes the structure to have a total height of 30.0 -feet, with the rear (north) side being calculated at 34.4 -feet of zoning height, even though the height of the tallest point is not changing. The additional height is caused by lower elevation of the starting point to the north. Applicant seeks Special Permit Relief under Bylaw Sections 139-33A and 17, and in the alternative a Variance to the extent necessary under Section 139-32, to allow the proposed addition to the rear/north side. This alteration has no negative impact on the neighborhood, and in fact helps to clean up a situation where there was over -crowding and an illegal dwelling. Due to the size and shape of the lot, the location of the structure, and the significant wetlands on the property, there is no other location to place the addition. Attached is a topographic map depicting existing grades is which is based on a field survey by our firm. There is no proposed change of grade as part of the pending application, or change in elevation of the ridge of the existing structure. The existing structure has an Average Mean Grade as specified in Ch. 139 Section 17 (hereafter, Bylaw) of 28.7 -feet with the rear (north) side at 32.5 -feet. The highest ridge of the existing structure is elevation 50.7 NAVD88. The proposed addition on the rear of the existing structure is an area of the lot that slopes away. As such, the Average Mean Grade calculation changes resulting in a higher structure height per the By-law. Note that the height of the addition from grade is approximately 12 -feet, though the By-law requires that the height for the overall structure be measured to a single highest point.
