The Applicants seek a Special Permit under Nantucket Zoning By-
law (the "By-law") §139-33.A(4) to remove and reconstruct any or
all of the preexisting nonconforming structures or any portion
thereof in excess of the permitted ground cover ratio upon the
Locus.
The Locus is a pre-existing, nonconforming lot of record, having
no frontage. Access to the property is achieved by way of an
easement from Shawkemo Road. The Locus has lot area of about
127,851 square feet where a minimum of 120,000 square feet is
required. As set forth in the Editor's note to By-law §139-16,
until January 1, 2000, the Locus had the benefit of Limited Use
General One ("LUG -1") intensity regulations and was allowed ground
cover of 70 or about 8,949 square feet. The Locus is currently
improved by a single-family dwelling, garage with studio, gazebo
(not counted toward ground cover), and playhouse, having total
ground cover of about 6,181 square feet or about 4.8%, where ground
cover of about 3,835 square feet or 3% is now allowed.
The Applicants propose to demolish all or portions of the existing
structures and to construct new structures or additions to the
existing structures, with the Locus, after such construction,
continuing to have total ground cover of up to about 6,181 square
feet or about 4.8%. All reconstructed structures or portions
thereof will conform to all applicable front, rear, and side yard
setback requirements.
Evidence of owner's title is registered as Certificate of Title
No. 18606 at Nantucket Registry District. The Locus is located at
8 Shawkemo Road, is shown on Nantucket Tax Assessor's Map 43 as
Parcel 90, and is located in Limited Use General Three ("LUG -3")

DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, August 9,
2018, at 1:00 P.M., at Four Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of JOSEPH A. DWORETZKY and AMY L. BANSE,
Trustees, as Applicants, and the Estate of Pauline Dalton, Owner, in care of Sarah F. Alger, Sarah
F. Alger, PC, Four North Water Street,Nantucket, Massachusetts 02554, File No. 28-18.
2. Applicants are seeking Special Permit relief pursuant to Nantucket Zoning By-law (the
"By-law") §139-33.A.(4) to remove and reconstruct any or all of the pre-existing nonconforming
structures or any portion thereof in excess of the permitted 3% ground cover ratio. Specifically,
Applicants propose to demolish all or portions of existing structures to allow for new construction
and/or additions with the ability to retain the pre-existing nonconforming ground cover ratio of up
to 4.8%. As a result of a zoning change from LUG-1 to LUG-3, the Locus became pre-existing
non-conforming as to groundcover. The new construction will be conforming as to all setback
requirements. The Locus, a pre-existing nonconforming lot of record as to frontage, is situated at
8 Shawkemo Road, is shown on Tax Assessor's Map 43 as Parcel 90, as Lot 9 upon Land Court
Plan 14732-B and as Lot 13 upon Land Court Plan 14732-D. Evidence of owner's title is registered
on Certificate of Title No. 18606 at the Nantucket County District of the Land Court. The site is
zoned Limited Use General 3 ("LUG-3").
3. Our decision is based upon the application and accompanying materials, representations
and testimony received at our public hearing. There was no Planning Board recommendation on
the basis that no matters of planning concern were presented. Except for presentation by the
applicant's representatives,there was no support nor opposition presented at the public hearing.
4. Attorney Sarah Alger represented the Applicants. Attorney Alger stated that the Applicants
are requesting Special Permit relief pursuant to Bylaw§139-33.A.(4) (removal and reconstruction
of structures exceeding allowable ground cover on Locus)to remove and reconstruct any or all of
the preexisting nonconforming structures or any portion thereof in excess of the permitted ground
cover ratio upon the Locus. The Locus is a pre-existing, nonconforming lot of record, having no
frontage, having ground cover in excess of the 3% permitted in the LUG-3 zoning district, and

having a garage that has side yard setback of about 10.8 feet at its closest point to the southwesterly
boundary line,where 20 feet is required. Access to the property is achieved by way of an easement
from Shawkemo Road. The Locus was in existence as of November 15, 1990 and, as a result,had
the benefit of LUG-1 intensity regulations until January 1, 2000, when the LUG-3 zoning
requirements became applicable to lots of record in this area. The structures on the Locus were all
built more than ten years ago,with the exception of the detached shed,which is not counted toward
ground cover under the definition of"ground cover"in By-law§139-2. The Locus has lot area of
about 127,851 square feet where a minimum of 120,000 square feet is required. As set forth in the
Editor's note to By-law §139-16, until January 1, 2000,the Locus had the benefit of Limited Use
General One("LUG-1")intensity regulations and was allowed ground cover of 7%or about 8,949
square feet. The Locus is currently improved by a single-family dwelling with two attached sheds,
a garage with studio, a detached shed and a gazebo (neither of which are counted toward ground
cover),and a playhouse,having total ground cover of about 6,181 square feet or about 4.8%,where
ground cover of about 3,835 square feet or 3%is now allowed.
5. Attorney Alger informed the Board that the Applicants propose to demolish all or portions
of the existing structures and to construct new structures or additions to the existing structures,
with the Locus, after such construction, continuing to have total ground cover of up to about 6,181
square feet or about 4.8%. All reconstructed structures or portions thereof will conform to all
applicable front, rear, and side yard setback requirements of the By-law, and there will be no
increase in ground cover or other zoning nonconformity.
6. Therefore, after a discussion with the Applicant's counsel, the Board finds that such a
Special Permit may be granted to allow demolition of all or portions of the existing structures and
construction of new structures or additions to the existing structures, with the Locus, after such
construction,continuing to have total ground cover of up to about 6,181 square feet or about 4.8%,
because all of the reconstructed structures or portions thereof will conform to all applicable front,
rear, and side yard setback requirements of the By-law, and there will be no increase in ground
cover or other zoning nonconformity.
7. Accordingly, by a UNANIMOUS vote of the sitting Board, the Board of Appeals made
the finding that the proposed demolition of all or portions of the existing structures and the
construction of new structures or additions to the existing structures, with the Locus, after such
construction,continuing to have total ground cover of up to about 6,181 square feet or about 4.8%,
and with all of the reconstructed structures or portions thereof conforming to all applicable front,
rear, and side yard setback requirements of the By-law, and no increase in ground cover or other
zoning nonconformity, will not be substantially more detrimental to the neighborhood than the
existing nonconformities and granted the requested relief by Special Permit.
