Applicant is seeking relief by Special Permit pursuant to Nantucket Zoning By-law Section 139-33A.
Applicant is the contract purchaser of the property and proposes to add about 200 SF of ground cover to
this single -story dwelling in order to expand an existing bedroom and add a handicap bathroom to this
single-family dwelling for her mother who is in a wheel chair. The property had been conforming when the
property had been zoned LUG -1. However, in 2000 thereabouts the area was re -zoned to LUG -3 and the
property became pre-existing non -conforming as to groundcover and lot size. The area to be expanded is
on the westerly and northwesterly side of the dwelling. The addition will be conforming as to all setback
requirements. The current ground cover is about 4.5% with the maximum allowed in the LUG -3 zoning
district being 3%. Prior to the change in zoning, the LUG -1 zoning district allowed a maximum ground
cover of 7%. The ground cover would be increased from about 4.5% to about 5.0%. The lot has a lot size
of about 46,038 SF in a district that requires a minimum lot size of 120,000 SF. The about .5% of
additional one-story ground cover would not be substantially more detrimental to the neighborhood than
the existing dwelling and the proposed additional ground cover is di minimus. The lot is also impacted by
substantial wetlands to the east and the addition would be at the farthest point away from the wetlands. In
the alternative, the Applicant is seeking relief by Variance pursuant to Section 139-16 (ground cover) to
complete the project as proposed.
