existing ground cover on the locus located at 138 Miacomet Road, Nantucket,
MA 02554 (the "Premises"). Further to this application, enclosed please find the

ADDENDUM TO ZONING BOARD OF APPEALS APPLICATION

NANTUCKET TAX ACCESSOR'S MAP: 81 PARCEL: 6.2
Introduction
The Applicants, Paul Gaucher and Peter Niemitz (hereinafter the "Applicants"), are the
owners of the property located at 138 Miacomet Road, Nantucket, MA 02554 (the "Premises").
The Premises is shown as Lot 1 on Land Court Plan 13648-B, registered at the Nantucket Registry
District of the Land Court, and as Parcel 6.2 on Nantucket Town Assessor's Map 81. The
Applicants hereby request Variance Relief pursuant to § 13 9-3 2 of the Nantucket Zoning By -Law
(the "By -Law"). The Premises is located in the Limited Use General -2 ("LUG -2") Zoning District.
Relief Sou,Qht
The Applicants are seeking relief by Variance under Nantucket Zoning By-law § 13 9-3 2
from the intensity regulations of the By-law §139-16 to validate the existing ground cover of
about 3,223 square feet on the locus. The locus exceeds the minimum lot area of parcels in the
LUG -2 Zoning District as it consists of 80,175 square feet, where a minimum lot area of 80,000
square feet is required. The Premises complies with the Zoning By-law in all other respects.
The locus is currently improved with a primary single-family dwelling, having a ground
cover of about 2,514 + square feet, a single story garage containing 289 + square feet of ground
cover, and a studio containing 420 + square feet of ground cover, totaling 3223 square feet of
ground cover (see plan drafted by Blackwell and Associates, Inc., entitled `Building Location
Plan of Land in Nantucket, MA, dated October 20, 2017, and attached hereto as Exhibit A).
The maximum ground cover permitted on this Locus, as it is located in the LUG -2
Zoning District, is 4% or 3,207 square feet (80,175 x .04 = 3,207). Therefore, the Applicants'
existing ground cover of 3,223 exceeds the maximum permitted ground cover by 16 square feet
(3,223 - 3,207 = 16) or .0002875 %.
Locus History
The Applicants purchased the Premises on November 1, 2015, by virtue of Deed
recorded as Document No. 149974 at the Nantucket Registry District of the Land Court. At the
time of their purchase, the property consisted of approximately 2,485.425 + square feet of
ground cover, or 3.1%, and complied with the Zoning By -Law in all respects (see plan drawn by
Robert A. Emack, dated November 9, 2015 and attached hereto as Exhibit B). In 2016, the
Applicants applied for a Building Permit and subsequently amended it, to construct a "1 story
24' x 24' Living Room addition with a 6' x 10' connector to existing dwelling. Additional 12' x
15' Bathroom [and] w/ 240 s.f. open porch" (see building permits attached hereto as Exhibit C).
The above -referenced work was performed in accordance with duly issued permits from
the Nantucket Building Department, and all Certificates of Appropriateness duly issued by the
Nantucket Historical District Commission. Part of the addition to the Primary dwelling included
what the Applicant believed to be a bay window, consisting of 26 ± square feet (see Exhibit A).
The definition of Ground Cover in § 139-2 of the By-law provides that the area associated
with a bay or bow window is excluded from being used to calculate ground cover. Upon
completion of the work described herein, the Applicants submitted their building permit for a
certificate of occupancy to the Nantucket Building Department. The Applicants received final
inspection signatures from all relevant inspectors at the Nantucket Building Department, except
for the Nantucket Zoning Enforcement officer.
It is the Zoning Enforcement Officer's position that the portion of mass located on the
southern side of the primary dwelling, identified on Exhibit A as "window with no foundation
below,".... "is neither a bay or bow window" (See the Zoning Enforcement Officer's Letter,
dated February 27, 2018, and attached hereto as Exhibit D).
As a result of the Zoning Enforcement Officer's decision, the total ground cover for the
locus is 3,223 square feet, and therefore is over its' total permitted ground cover by 16 square
feet.
Praver for Relief
The Applicants hereby request that the Board grant the Variance as requested herein. By
granting the variance that has been requested, the Board will be acting in a manner consistent
with the spirit and intent of the Nantucket Zoning By -Law.
A literal enforcement of the provisions of by-law requiring removal of the bay window
would involve substantial hardship to the Applicants.
The relief that has been requested by the Applicants may be granted without substantial
detriment to the public good and without nullifying or substantially derogating from intents and
purposes of the by-law.

Your request for a Certificate of Occupancy for work performed under Building Permit #1921-16 at
138 Miacomet Rd. (Map# 81, Parcel# 6.2) cannot be processed at this time for the following
reason(s);
Per the as -built plot plan (Blackwell, 10/20/2017) submitted with your request, the structures
exceed the maximum allowable ground coverage for the property, in violation of §139-16 of the
Nantucket Zoning Code. The issue appears to be caused by construction of the area labeled on said
plan as "Window with no foundation below 26s.f. (_ ( 4
"Ground Cover" is defined in §139-2 of the zoning bylaw as "The horizontal area of a lot covered at
grade by structures, together with those portions of any overhangs which contain enclosed interior
space...". Among others, said definition exempts "bay and bow windows." Attached is a photo of said
section.
I find that the 26 s.f. section of the dwelling is neither a bay nor a bow window as either term is
generally known or understood, and that said area does constitute an overhang that contains
enclosed interior space. As such, the total ground coverage of all structures on the lot equals 3,223
s.f. where a maximum ground coverage of 3,207 s.f. (4% of the lot area of 80,175 s.f. in the LUG -2
zoning district) is allowed.
You are required to either bring the structures into compliance with the ground cover requirement
of §139-16, or receive relief from said requirement through the Zoning Board of Appeals. If you
choose to seek relief, please contact Eleanor Antonietti, ZBA Administrator, at 508-325-7587, ext.
7010, for information on how to proceed.
If you are aggrieved by this denial, you may file appeal with the Zoning Board of Appeals within
thirty (30) days of the date of the notice.
