The Lot is a pre-existing nonconforming lot with 50 feet of frontage where 75 feet is required and it has 41,499 SF of lot area split between the Residential 20 (R-20) and Limited Use General 2 (LUG -2). The available building envelop is severely limited due to the long narrow shape of the lot, zoning setbacks, soil conditions, wetlands and associate buffer zones, and the split zoning. The existing house is sited within the western side yard setback, as close as 1.7 feet where ten feet is required. The encroachment (by a prior owner) does not pre -date 1972, but is more than 10 years old, so it qualifies as pre-existing non -conforming under the recent 2017 STM Article 17 Changes to the Bylaw. Applicant seeks relief by Special Permit pursuant to Zoning By-law Section 139-33.A to alter or replace a pre-existing nonconforming dwelling. Applicant propose to alter an existing house or to demolish it and build a new one, a portion of which will remain within the side yard encroachment. The new or renovated dwelling would maintain the encroachment, currently a two story house and basement stairs with the same, but would not get closer to the westerly lot line than the existing structure or otherwise increase the nonconformity. At a public hearing of the Nantucket Zoning Board of Appeals (the "Board") held at 1:00 P.M. on Thursday, March 8, 2018, in the Conference Room, at 4 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following Decision on the application of 34 WESTERN AVENUE SURFSIDE LLC (the "Applicant"), do Cohen & Cohen Law PC, 34 Main Street, 2nd Floor, P.O. Box 786,Nantucket, MA 02554, in File No. 09- 18. 2. Applicant requested relief by Special Permit pursuant to Zoning By-law Sections 139- 30.A and 139-33.A to alter and expand or replace a pre-existing nonconforming dwelling. Applicant proposes to either renovate and expand or to demolish and build a new expanded dwelling. The structure is currently sited as close as 1.6 feet from the westerly side yard lot line. The proposed new or renovated dwelling would maintain the encroachment of the existing two story house and basement stairs, but would get no closer to the lot line than the existing structure or otherwise increase the setback nonconformity. The Locus is situated at 34 Western Avenue, is shown on Assessor's Map 87 as Parcel 82, and as Lot 1 upon Land Court Plan 8597-F. Evidence of owner's title is registered on Certificate of Title No. 26758 at the Nantucket County District of the Land Court. The site is zoned Residential 20 (R-20) and Limited Use General 2 (LUG-2). 3. The Board's decision is based upon the application and accompanying materials, representations, and testimony received at the public hearing. There was no Planning Board recommendation, on the basis that no matters of planning concern were presented. No opposition, written or oral, was presented at the hearings. 4. As shown upon plan entitled, "Existing Conditions Plan in Nantucket, Massachusetts", dated February 5, 2018, revised April 12, 2018, and prepared by Bracken Engineering, Inc., a reduced copy of which is attached herewith as "Exhibit A", Locus is a pre- existing nonconforming lot with fifty (50) feet of frontage in the Residential Twenty (R- 20) zoning district where required frontage is seventy-five (75) feet. The lot, which contains approximately 41,499 square feet, has split zoning with the northerly portion of the lot being located in the R-20 zoning district and the southerly ocean-side portion being located in the LUG-2 zoning district. The available building envelop is severely limited due to the long narrow shape of the lot, zoning setbacks, soil conditions, wetlands 2 with associated buffer zones, and the split zoning. The existing dwelling contains 1,004 square feet and is sited within the ten (10) foot westerly side yard setback. The areaway of the existing house is sited as close as 1.6 feet and a portion of the main mass is sited as close as 5.5 feet from the westerly lot line. 5. While the setback encroachment does not pre-date 1972, it has existed for more than ten (10) years. As such, it qualifies as legally nonconforming under Zoning By-law Section 139-33.A, as amended by the passage of Article 17 at the 2017 Special Town Meeting on November 6, 2017. The Applicant seeks relief by Special Permit pursuant to Sections 139-30.A and 139-33.A to alter or replace and expand a pre-existing nonconforming dwelling. 6. Applicant, as represented by legal counsel and the project architect, explained the proposal to either renovate and expand the existing dwelling or to demolish it and construct a new larger dwelling. In either case, a portion of the dwelling will remain within the ten (10) foot westerly side yard setback without coming any closer to the westerly lot line than the existing structure. The initial proposal showed a new 1,373 square foot dwelling with an areaway sited as close as 1.7 feet from the westerly lot line and two air conditioning units tucked behind a bump out encroaching within the ten (10) foot side yard setback. The main mass of the proposed structure, aside from the bump out and basement stair areaway, is sited virtually flush with the ten foot side yard setback line. 7. After discussion with the Board about relocating the basement access stairs and air conditioning units further from the lot line than initially proposed, Applicant agreed to shift them to a less nonconforming distance, reducing the encroachment to the current distance of the westernmost wall of the structure (5.5 feet) from the lot line. 8. Therefore, in accordance with the foregoing, the Board made the finding that the requested relief by Special Permit to allow the proposed alterations could be granted based upon the findings that the nonconforming setback distance will not be made more nonconforming and that the extension will not be substantially more detrimental to the neighborhood than the existing nonconformity. 9. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested SPECIAL PERMIT relief pursuant to Sections 139-30.A and 139-33.A subject to the following condition: a. That the new dwelling, including the basement stair areaway and A/C condensers, if any, shall be sited no closer than 5.5 feet from the westerly lot line.
