Map 55.4.1, Parcel 74.1
Applicants, John R. And Greer K. Hendricks, are owners of the I Jefferson Lane property
(the "Locus") by a deed recorded in Book 1624, Page 107. The Hendricks are requesting a
Special Permit per Nantucket Zoning By -Law Section 139-33. A. (1)(a) in order to alter a
preexisting nonconforming structure.
The current property boundaries were established per Plan of Land recorded at the
Nantucket Registry of Deeds as plan number 2015-92 pursuant to Massachusetts General Laws
Chapter 41 Section 81 L which divided the property into two lots on which two buildings were
standing when the subdivision control law went into effect in Nantucket. The existing building
on the locus does not comply with side and rear setbacks in the ROH district.
The Applicants propose to construct a new primary dwelling that complies with all
setbacks and raze the existing nonconforming building and construct a studio in the same
locaiton. The new studio will comply with all dimensional requirements except for the proposed
areaway to access the proposed crawl space foundation.
The studio shall be substantially less detrimental than the existing nonconforming
structure based on the following:
• The existing rear yard setback to the structure is 1.7'+/- and the proposed rear yard
setback to the main structure will be 5.5'+/-;
• The proposed rear yard setback to the crawl space access will be 1.7' +/-, which is no less
than the existing structure. Also, the areaway will only be slightly above grade which
creates more open-air space in the rear yard over what is existing;
• The existing side yard setback to the structure is 2.2' and the proposed side yard setback
shall be 5.5';
• The overall structure area will be substantially reduced from 694 square feet +/- to 330
square feet +/-;
• Two parking spaces will be constructed on-site. There are currently no parking spaces on-
site.
In summary, the alterations do not increase the nonconforming nature of the structure. The
alterations shall be more conforming than the preexisting nonconforming structure. Therefore, it
is the applicant's opinion that Special permit relief may be granted as the proposed alterations
are not substantially more detrimental to the neighborhood than the existing structure.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals, held on Thursday, March
8, 2018, at 1:00 P.M., in the First Floor Community Room of the Public Safety Facility at Four
Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the
application of JOHN R. HENDRICKS and GREER K. HENDRICKS, 1212 Fifth Avenue,
New York,New York 10029, File No. 05-18:
2. Applicant is seeking Special Permit relief pursuant to By-law Sections 139-30.A and
139-33.A to allow the alteration of a pre-existing nonconforming structure upon a pre-existing
nonconforming lot. Applicant proposes to construct a dimensionally compliant primary dwelling
and to remove a 694 square foot accessory structure, which is nonconforming as to use and side
and rear setbacks, and replace it with a 330 square foot studio, which is proposed to be sited 5.5
feet from the side yard lot line and as close as 1.7 feet from the rear yard lot line where side and
rear yard setbacks are 5 feet. The alterations will thus cure the side yard setback nonconformity,
will decrease the rear yard setback intrusion, and will render the lot conforming as to uses. The
Locus, an undersized lot of record, is situated at 1 Jefferson Lane, is shown on Assessor's Map
55.4.1 as Parcel 74.1, and as Lot 1 on Plan No. 2015-92. Evidence of owner's title is recorded in
Book 1624, Page 107 on file at the Nantucket Registry of Deeds. The site is zoned Residential
Old Historic (ROH).
3. Our decision is based upon the application and accompanying materials and
representations and testimony received at our public hearing. There was no Planning Board
recommendation on the basis that no matters of planning concern were presented. There was one
letter of concern from a direct abutter requesting that the replacement structure be further from
the shared lot line that the existing. There was no other opposition, written or oral, to the
application.

4. Existing and Proposed conditions are shown on plan entitled, "Proposed Site Plan in
Nantucket, Massachusetts" prepared for: John R. and Greer K Hendricks, by Bracken
Engineering, Inc., and dated January 31, 2018, attached hereto as "Exhibit A" (Site Plan). The
Locus is pre-existing, nonconforming under By-law Section 139-33.A(3), having been created

of subdivision control in the Town. The lot is nonconforming as to area, containing about 3,626
square feet where 5,000 square feet is minimum required lot area. The existing structure is pre-
existing, nonconforming as to side and rear yard setbacks, being sited as close as 2.2 feet from
the easterly side yard lot line and as close as one (1) feet from the northerly rear lot line, where
minimum required side and rear yard setbacks are five (5) feet.
5. Locus, shown as Lot 1 upon Plan No. 2015-92 (ANR plan), currently has a one-bedroom,
one-bath cottage, containing approximately 694 square feet. This accessory structure was
separated from the main house, located on 55 Fair Street shown as Lot 2 on the ANR plan, by
virtue of the 81L subdivision. As a result, the cottage became the principal structure for Lot 1
upon subdivision and is no longer"accessory to a residential use".
Section 139-33.D Once changed to a conforming use, no structure or use shall be
permitted to revert to a nonconforming use;provided, however, that:
(1)An accessory building which is accessory to a residential use and has no
commercial use may be razed and reconstructed with substantially the same
configuration, ground cover, siting and use.
Therefore, its use was rendered nonconforming by virtue of the 81L and Section 139-33.D does
not apply. As such, the project requires relief by Special Permit pursuant to Section 139-33.A.
While the proposed project entails installation of conforming uses, the applicants are nonetheless
altering a pre-existing nonconforming situation. Although the changes could be considered an
intensification of the uses upon the lot, the proposed uses are allowed by right and in harmony
with the purposes and intent of the bylaw.
6. As explained by Applicant's representative and shown on the above-referenced Site Plan,
the Applicant is seeking approval to: 1) construct a new 1,024 square foot dimensionally
conforming primary dwelling unit; 2) remove the 694 square foot pre-existing nonconforming
accessory structure, and; 3) construct a new smaller (330 square foot) studio structure. The
proposed studio will be less nonconforming as to rear year setback, conforming as to side yard
setback, and an allowed accessory use. In addition, the portion of the structure which will be
sited within the five (5) foot rear yard setback is an areaway with steps providing access to a
crawlspace, whereas the main wall of the studio will be sited outside of the setback. The new
structure will have an approximate ridge height of 17'-0"±. The project benefits from Historic
District Commission approvals by virtue of Certificate of Appropriateness No.s 67319 for the
studio (as amended by No.s 67889, 67936, and 69117) and 67471 for the dwelling.
7. Therefore, the new studio structure will be sited slightly further than the existing cottage
from the rear yard lot line and the side yard setback intrusion will be cured. The Locus is and
will remain compliant as to ground cover. The total adjusted parking requirement, pursuant to
Section 139-18.B, will be one (1) space, with two compliant spaces provided upon the premises.

8. In consideration of the testimony received at the hearing and based upon the above-
referenced Site Plan, the Zoning Board of Appeals made a determination that the requested relief
may be granted based upon the findings that the proposed project will not make the existing
nonconforming setback distances more nonconforming, will establish conforming residential
uses upon the premises, and will not be substantially more detrimental to the neighborhood than
the existing nonconformities.
9. Accordingly, by a UNANIMOUS vote, the sitting Board GRANTS the requested
SPECIAL PERMIT relief pursuant to the provisions of Zoning By-law Sections 139-30 and
139-33.A to allow the alteration of a pre-existing nonconforming accessory structure upon a
pre-existing nonconforming lot. The new structure shall be used as a studio, a conforming use
accessory to a conforming primary dwelling. The studio will be conforming as to side yard
setback, will be nonconforming as to rear yard setback, but will not come any closer to the
northerly lot line than the existing structure. The relief is subject to the following conditions:
a) The work shall be performed in substantial conformance with plans approved in
connection with HDC Certificates of Appropriateness sited above, as the same
may amended from time to time, and as shown on the Site Plan.
b) Appropriate measures shall be taken by applicants to protect the plantings along
the shared lot line with 53 Fair Street. Should any damage occur as a result of
the work contemplated herein, the applicants will restore the plantings to their
original state at their own expense.
c) There shall be no exterior construction or hardscaping in connection with the
project contemplated herein between Memorial Day and Labor Day of any
given year.
