At a Public Hearing of the NANTUCKET ZONING BOARD OF
APPEALS, held at 1:00 P.M., Friday, July 8, 1994, in the Town and
County Building, Broad Street, Nantucket, MA, on the Application of
RHODA H. WEINMAN, TRUSTEE, AUGUSTUS SHANNON REALTY TRUST, of Box
954, Nantucket, MA 02554, File No. 052 -94, the Board made the
following Decision:
1. Applicant seeks relief by Special Permit under Nantucket
Zoning By -Law §139- 9B(2)(b), (storage and warehousing) and, to the
extent necessary, Special Permit relief under Nantucket Zoning
By -Law §139 -20C, to allow the siting of a loading zone within the
side yard setback. A five (5) foot side yard setback is required and
the lading zone would be sited three (3) feet from the side lot
line.
The premises is located at 17 (part) and 19 Boynton Lane, Lot
C, Assessor's Map 67, Parcel 14.7 (part), and Parcel 14.6,
respectively, as shown in Plan Book 25, Page C, Lots 3 (part) and 2,
respectively. The property is zoned Residential - Commercial -2.
2. The Decision is based upon the Application and materials
submitted with it, the testimony and evidence presented at the
Hearing and fourteen (14) letters in support by abutters submitted
at the meeting. No opposition was expressed and the Planning Staff
made a favorable recommendation.
3. Applicant proposes to construct a building that will contain
a total square footage of floor space of 3,200+ feet with 2,300±
square feet of ground cover, on a vacant lot in a commercial zone.
The structure will be used for the storage of household and small
business goods, "dead storage ". There will be no hazardous materials
stored on site and Applicant is providing five (5) parking spaces
when four (4) are required under the By -Law. The loading zone will
meet all dimensional requirements but due to the narrowness of the
lot, must be sited within the required westerly five (5) foot side
yard setback, having a setback of 3+ feet. Applicant further
represented that they will be in compliance with the 20% green space
requirements.
4. As the Historic District Commission had not granted a
Certificate of Appropriateness as of the Hearing, Applicant
submitted preliminary "sketch plans" showing the proposed
elevations which are on file at the Board of Appeals.

WEINMAN, TRUSTEE, AUGUSTUS SHANNON REALTY TRUST, of P.O. Box 954
Nantucket, MA 02554, File No. 053 -94, the Board made the following
Decision:
1. Applicant seeks relief by Special Permit under Nantucket
Zoning By -Law §139- 9B(2)(b), storage and warehousing.
The premises is located at 17 BOYNTON LANE, Lot D, Assessor's
Map 68, Parcel 14.7, as shown in Plan Book 25, Page C. The property
is zoned Residential Commercial -2.
2. The Decision is based upon the Application and papers
submitted with it, the testimony and evidence presented at the
Hearing and fourteen (14) letters is support by abutters submitted at
the meeting. No opposition was expressed and the Planning Board Staff
made a favorable recommendation.
3. Applicant proposes to construct a building that will contain
1296+ square feet of ground cover and be of a long narrow shape that
may be divided into several separate rental units used for the
storage of household and /or small business related items, "dead
storage ". There will be no hazardous materials stored on the site and
Applicant is providing two (2) parking spaces, when one (1) is
required under the By -Law. Additionally, the loading zone and green
space requirements will be met.
4. As the Historic District Commission had not granted a
Certificate of Appropriateness as of the Hearing, Applicant submitted
"preliminary sketch plans" showing the proposed elevations which are
on file at the Board of Appeals.
5. As the aisle width within the lot itself, that will be used to
access the loading zone, is subminimum, subject Lot D will be
benefited by an easement granted by the adjoining Lot C, the subject
of Board of Appeals File No. 052 -94. This easement will satisfy the
aisle width requirements for this lot.
6. Accordingly, by unanimous vote, the Board GRANTS the
requested Special Permit relief under §139- 9B(2)(b) and further
finds that the proposed use is in harmony with the general purpose
(053 -94)

and intent of the Zoning By -Law, subject to the following
conditions:
a. The 1,296 ±SF structure will be used for the storage of
household and /or small business related items;
b.
There will be
no hazardous
materials
stored on the site;

d. Applicant will provide two (2) conforming parking spaces
though one (1) is required under the By -Law; and
