The applicants propose to alter the pre-existing, nonconforming
garage upon locus, which is situated in the easterly side yard setback
area with the closest point being about 0.33 foot from the property
line (5 feet being minimum side yard setback in this ROH zoning
district), by adding a second floor to be used as a studio. The
footprint of the structure within the setback area will not be
changed. All other changes, including steps for second story access
and a second story deck with condenser below, will be outside the
setback area. Applicants request a Special Permit under Nantucket
Zoning By-law § 139-33.A for the alteration of the pre-existing,
nonconforming structure. The single-family dwelling upon locus was
built in 1987 and conforms to all zoning requirements.

1. At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, September
14, 2017, at 1:00 P.M., at 4 Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of ALLAN D. McKELVIE and DARINA C.
McKELVIE, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket,
Massachusetts 02584, File No. 31-17:
2. The applicants propose to alter the pre-existing, nonconforming garage upon locus, which
is situated in the easterly side yard setback area with the closest point being about 0.33 foot from
the property line (5 feet being minimum side yard setback in this ROH zoning district), by
adding a second floor to be used as a studio. The footprint of the structure within the setback
area will not be changed. All other changes, including steps for second story access and a
second story deck with condenser below, will be outside the setback area. Applicants request a
Special Permit pursuant to Nantucket Zoning By-law § 139-33.A for the alteration of the pre-
existing, nonconforming structure. The single-family dwelling upon locus was built in 1987 and
conforms to all zoning requirements. The present and proposed conditions upon locus are shown
upon two plans by Blackwell & Associates, Inc., dated August 10, 2017, reduced copies of
which are attached hereto as "Exhibit A" and "Exhibit B", respectively. Locus is situated at 6
Candle House Lane, Assessor's Parcel 55.4.4-52.1, is shown upon plan recorded with Nantucket
Deeds in Plan Book 20, Page 107, as Lot 1, and is situated in a Residential Old Historic (ROH)
zoning district.
3. Our decision is based upon the application and accompanying materials, and
representations and testimony received at our public hearing. There was no Planning Board
recommendation, on the basis that there was no matter of planning concern. There was no
support nor opposition presented at the public hearing.
4. As explained by the applicant's representative at the public hearing, there is no proposed
change to the footprint of the garage structure within the setback area; the only change will be
vertical expansion, including addition of a dormer. The Board expressed concern that because of
the proximity of the structure to the lot line, no work could be done on the foundation without
affecting the adjacent property. The applicant's representative concurred that no work on the
foundation was proposed.
5. Based upon the foregoing presentation, the Board of Appeals, by UNANIMOUS vote,
found that the proposed alteration to the pre-existing, nonconforming garage structure upon locus
and its conversion to contain a studio, as shown upon the Blackwell plans attached hereto. would

not be substantially more detrimental to the neighborhood than the existing nonconformities, and
GRANTED relief by SPECIAL PERMIT pursuant to Nantucket Zoning By-law § 139-33.A to
authorize the proposed work, subject to the following conditions:
(a) There shall be no major excavation when renovating the foundation of the
structure; and
(b) No exterior work shall be performed between Memorial Day and Labor
Day in any year.
