At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday. September 14, 2017, at 1:00 P.M., at 4 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of 23 COMMERCIAL WHARF J.A., LLC. c/o 20 Chapel Street, Brookline, Massachusetts 02446, File No. 030-17: 2. This is an application for a MODIFICATION of SPECIAL PERMIT No. 039-16 to include additional special conditions in the previously granted SPECIAL PERMIT to limit the proposed renovated cottage to residential use only, to prohibit public access to the Premises and to require the removal of the floating dock adjacent to the Premises by Columbus Day with installation of the floating dock no earlier than Memorial Day. 3. Our decision is based upon the application and accompanying materials, representations. and testimony received at our public hearing. The Applicant, through counsel. stated that a neighbor had appealed from the issuance of a prior Nantucket Planning Board Special Permit No. 32-13 allowing the renovation of the dilapidated cottage on the Premises and also appealed from the issuance of existing Nantucket Board of Appeals' Special Permit No. 039-16 allowing the renovation of the cottage. The Applicant and the appellant neighbor have reached a settlement agreement to resolve the pending litigation which is contingent upon a modification of Special Permit No. 039-16 to include the following additional special conditions: d. The Locus, including without limitation the proposed renovated cottage, proposed porch, and proposed seasonal floating dock, shall be used for private residential purposes only. Notwithstanding that certain commercial and other non-residential uses are permitted in the RC Zoning District by right or by special permit, such uses are prohibited on the Locus. e. There shall be no public access to the Locus, including without limitation the proposed renovated cottage, proposed porch, and proposed seasonal floating dock, at any time. 2 f. Each year, the seasonal floating dock may be installed on or after Memorial Day and shall be removed on or before Columbus Day. 4. The BOARD finds that the incorporation of above special conditions d., e., and f. into SPECIAL PERMIT No. 039-16 is reasonable and will not be substantially more detrimental to the Commercial Wharf neighborhood that the terms and provisions of the previously granted Special Permit. Moreover, the requested modification of the Special Permit will end vexatious litigation and foster harmony in the Commercial Wharf neighborhood. 5. Accordingly, by a UNANIMOUS vote, the Board of Appeals GRANTS the requested MODIFICATION OF SPECIAL PERMIT No. 039-16 under the provisions of Zoning By Law Section 139-33.A and incorporates above special conditions d., e., and £ into SPECIAL PERMIT NO. 039-16 on the further condition that all of the provisions and conditions of previously granted SPECIAL PERMIT No. 039-16 shall remain in full force and effect.
