Exhibit A
Applicants, Scott B. Paton and Kristin S. Paton, are the owners of the 33 Orange
Street (the "Premises") by virtue of deed recorded in Book 1570, Page 270. Applicants
are requesting Special Permit relief pursuant to Zoning By-law Section 139-30 from the
provisions of Section 139-33.A in order to alter the pre-existing nonconforming dwelling
structure. Specifically, applicant proposes to renovate and build a 2 -story addition and
basement on the south and west elevations. A portion of the work will take place within
the northerly side yard setback. The dwelling will be no closer to the northerly side yard
lot line than the existing structure as a result of the proposed work.
The Premises is nonconforming with respect to lot size and setbacks. The lot,
which has approximately 4,002 square feet in the ROH zoning district, has a primary
dwelling and shed, both sited within the setbacks. The primary dwelling is sited as close
as 0.3 feet from the northerly side yard setback in a zoning district that requires a five (5)
foot side yard setback. The existing shed is sited as close as 0.6 feet from the westerly
rear yard setback and 0.4 feet from the southerly side yard setback, however, no
alterations are proposed to said shed. The structures have been sited in their present
location since prior to the adoption of the Zoning Bylaw and the setback violations
thereon are considered grandfathered and have preexisting nonconforming status. The
structures do, however, conform to the maximum ground cover ratio allowed in the ROH
district (50% for undersized lots of record) and with the proposed alteration, will continue
to do so.
The Applicants propose to alter the structure by southerly and westerly expanding
the westernmost portion of the structure, renovating and constructing a two-story
addition, and a basement. The structure will not be getting any closer to the northerly
nonconforming side yard setback than what presently exists shown a site plan prepared
by J. Marcklinger & Associates, P.L.S., dated May 24, 2017, attached hereto as Exhibit
B. Said alterations have been approved by virtue of Historic District Commission
Certificate of Appropriateness No. 67837.
Therefore, because the addition to the structure does not increase the
nonconforming nature of the structure because said additions will be no closer to the lot
lines than the preexisting nonconforming structure, Special Permit relief may be granted
as the proposed alterations are not substantially more detrimental to the neighborhood
than the existing nonconformity.
