At a public hearing of the Nantucket Zoning Board of Appeals ("Board "), opened at 1:00 P.M. on Thursday, June 8, 2017, in the Conference Room, at 4 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following Decision on the application of MARIANNE HANLEY, TRUSTEE of EIGHTY -SIX MAIN NOMINEE TRUST, 61 Anthony Boulevarde, Lincoln Park, NJ 07035, File No. 021 -17. 2. Applicant is requesting Special Permit relief pursuant to Zoning By -law Section 139- 33.A(1) in order to alter the structures upon the locus which are pre- existing nonconforming as to side yard setbacks. The proposed alterations to the dwelling consist of renovation and enclosure of an existing porch, removal of an encroaching deck and steps, construction of a new basement access, porch and steps, and various fenestration and door changes. The garage will be demolished and a new smaller garage /studio is proposed to be sited outside of all setbacks. The overall ground cover ratio will remain compliant with the 50% allowance and none of the alterations will bring the structures closer to the lot lines. The Locus, an undersized lot of record, is situated at 86 Main Street, is shown on Nantucket Tax Assessor's Map 42.3.3 as Parcel 66. Evidence of owner's title is recorded in Book 1557, Page 258 on file at the Nantucket County Registry of Deeds. The property is zoned Residential Old Historic (ROH). 3. Our decision is based upon the application and accompanying materials, representations, and testimony received at our public hearings. The Planning Board made no recommendation as their meeting occurred after this Board's meeting. There was no opposition, written and oral, presented at the public hearing. 4. The Applicant explained to the Board that the proposal consists of an alteration to the pre- existing nonconforming dwelling structure by renovating and enclosing a portion of an existing roofed porch and replacing an existing deck and stairs with a basement access within the side yard setbacks along the west elevation of the structure. Further 2 alterations include construction of a new porch and steps, to be sited outside of all setbacks, on the south elevation of the structure. Additional alterations include placement and installation of new windows and doors in portions of the structure sited within the five (5) yard side setbacks. The dwelling will be no closer to the respective side yard lot lines than the existing structure as a result of the proposed alterations which benefit from Historic District Commission approval by virtue of Certificate of Appropriateness 68030. 5. Applicant further proposes to demolish a pre- existing nonconforming garage, currently sited within the westerly side yard setback, in order to construct a new dimensionally conforming garage /studio. The proposed work for the garage /studio has been granted Historic District Commission approval by virtue of Certificate of Appropriateness 68138. 6. Existing conditions are shown on plan entitled, "Existing Conditions Plot Plan; 4 86 Main Street; in Nantucket, Massachusetts ", dated June 8, 2017, prepared by Nantucket Surveyors, LLC, a reduced copy of which is attached hereto as "Exhibit A ". The locus, a corner lot abutted by both Main Street to the north and Pine Street to the east, is a pre- existing nonconforming undersized lot of record, said to contain between 4,900± ( "Record Lot Area ") and 4,995± ( "Calculated Lot Area ") square feet in the Residential Old Historic (ROH) where minimum lot size is 5,000 square feet. The premises is improved with a dwelling and garage structure, both constructed prior to the adoption of the Nantucket Zoning By -Law and both pre- existing nonconforming with respect to the intensity regulations in the ROH Zoning District. More specifically, in a district which requires a five (5) foot minimum side yard setback distance, the structure is sited on or over the side yard lot lines at various points. 7. On the east elevation, the entire fayade of the dwelling is sited flush with the sidewalk which constitutes the eastern boundary of the locus. On the west elevation, a portion of the dwelling intrudes into the adjacent property at 88 Main Street. A "Boundary Line and Easement Agreement" is on file with the Registry of Deeds at Book 656, Page 170, memorializing "a perpetual easement for that portion of the above - described stairs and deck that encroach on the Vollmer property, as shown on Exhibit "A" hereto. Said easement shall include the right to repair, maintain, and replace said stairs and deck and shall run with the land forever. " The proposed alterations consist of removal and relocation of the portions of the deck and steps which straddle the lot line. The newly constructed basement access will continue to be sited within the five (5) foot side yard setbacks but will be further from the lot lines than the existing deck and steps. 8. The 2 '/2 story structure contains approximately 1,316 square feet. The existing garage is sited as close as 4.2 feet from the westerly side yard lot line and contains 0 approximately 412 square feet. The resulting ground cover ratio of the two structures is 38.4% where 50% is maximum allowable ground cover ratio. 9. The proposed conditions are shown on plan entitled, "ZBA Exhibit Plot Plan; 4 86 Main Street; in Nantucket, Massachusetts ", dated June 8, 2017, prepared by Nantucket Surveyors, LLC, a reduced copy of which is attached hereto as "Exhibit B ". The proposed alterations consist of 1) renovation and enclosure of a portion of an existing porch; 2) removal of the encroaching deck and steps; 3) construction of a new basement access, porch and steps; 4) various fenestration and door changes; 5) demolition of a pre- existing nonconforming 412 square foot garage; and 6) construction of a new 373 square foot garage /studio sited outside of all setbacks. The overall ground cover ratio will remain compliant with the 50% ROH allowance. 10. Based upon the testimony received at the hearing and the proposed conditions site plan, a reduced copy of which is attached herewith as "Exhibit B ", the Zoning Board of Appeals made a determination that the requested relief may be granted based upon the findings that the proposed project will not make the existing nonconforming setback distances more nonconforming and will not be substantially more detrimental to the neighborhood than the existing nonconformities. 11. Accordingly, by a UNANIMOUS vote of the sitting Board, the Zoning Board of Appeals GRANTED the requested relief by SPECIAL PERMIT pursuant to By -law 139- 33.A(1) in order to alter the structures upon the locus. Relief is subject to the following conditions: a. The proposed alterations shall be performed in accordance with the above - referenced Site Plan attached herewith as "Exhibit B "; b. The proposed alterations shall be performed in substantial conformity with the plans approved in conjunction with Certificate of Appropriateness No. 68030 and No. 68138 granted by the Nantucket Historic District Commission, as the same may be amended from time to time; c. Any additional vertical expansion within the westerly setback, including the addition of a second floor deck above the existing porch, shall require further relief from this Board; and d. There shall be no exterior construction between Memorial Day and Labor Day of any given year relative to the construction contemplated under this decision.
