Upon review of the application submitted by the Applicant for the above-referenced property, it was determined by the Zoning Administrator pursuant to Nantucket Zoning By-Law Section 139-33.A(1)(b) that the proposed alterations and additions to the pre- existing non-conforming structure upon the pre-existing nonconforming lot shall neither increase the nonconforming nature nor create a new nonconformity upon the locus. 2. The Applicant is proposing to alter the pre-existing nonconforming structure by removing an existing oil tank and installing a heat pump, four columns, and a 120 gallon gas tank on the rear elevation of the two story single-family dwelling. The proposed additions are located underneath an existing overhang which contains occupied space and lies within the five (5) foot side and rear yard setbacks. Other proposed alterations which do not require relief include the addition of an arbor/trellis and a screening fence. The installations will neither increase the pre-existing nonconforming setbacks of the structure nor create any new non-conformities. 3. Existing and proposed conditions of the Locus are shown on plan entitled, "ZBA Exhibit Plot Plan; # 2 Trader's Lane; in Nantucket, Massachusetts", dated March 31, 2017, prepared by Nantucket Surveyors, LLC, a reduced copy of which is attached hereto as "Exhibit A". The dwelling structure was constructed prior to the adoption of the Nantucket Zoning By-Law and is pre-existing nonconforming with respect to the zoning regulations in the Residential Old Historic (ROH) Zoning District. More specifically, in a district which requires a five (5) foot minimum side and rear yard setback distance, the dwelling is sited approximately 1.2 feet from the northerly side yard lot line, 0.1 foot from the easterly rear yard lot line, and 3.5 feet from the southerly side yard lot line, each at its closest point. The two story structure contains approximately 557 square feet for a ground cover ratio of approximately 60% where 50% is maximum allowable ground cover ratio. The locus is a pre-existing nonconforming undersized lot of record, containing 933 square feet of lot area in the ROH where minimum lot size is 5,000 square feet and having approximately 28.84 feet of frontage where minimum frontage is fifty (50) feet. 4.
